Supersmashing Ebay T-Shirts - Terms & Conditions of Sale By placing an order with Supersmashing T-Shirts(“us”), PO BO 1163, Norwich, Norfolk, NR13 5WP, you agree to purchase the items placed into your paypal shopping basket (“the goods”) on the following terms and conditions. The terms do not affect your statutory rights as a consumer. Please print and retain a copy of your order and these terms and conditions for your records once you have submitted your order. 1. Your Order We must receive full details of your debit/ credit card with your order for the goods. Paypal will not conclude a transaction unless full details are supplied and verified. Your card or paypal account will be charged at the time of purchase by paypal. It may take up to 48 hours for card details to be verified in some cases. Once we have received payment from you we will confirm that your order has been accepted by sending an automated paypal receipt email to you at the email address you provide in your order form. We will also notify you by email when the goods have been despatched. Our acceptance of your order brings into existence a legally binding contract between us. 2. Price The prices payable for the goods you order are the prices set out on our listing in pounds sterling on the date of your order. Our prices are inclusive of VAT and exclusive of any delivery charge. In addition to the price, you are required to pay any applicable delivery charge set out on our website. 3. Goods All goods promoted for sale by us are of satisfactory quality and conform with the description on our listing. 4. Cancellation Policy You have the right to cancel your order in writing at any time up to the end of the seventh working day following receipt of the goods. You do not need to give any reason for cancelling your contract nor will you have to pay a penalty. This right does not apply to goods which have been personalised or made to your specification; audio/video recordings or software which you have unsealed; items such as earrings/underwear that cannot be returned for reasons of hygiene; and periodicals and magazines. If you cancel your order after you have received the goods or after the goods have been despatched by us, you must return the goods (in the condition in which they were delivered to you) to our contact address at your own cost as soon as possible. Once you have notified us that you are cancelling your contract and as long as the goods in question are returned and received by us in the condition they were in when delivered to you, we will credit your debit/credit card with any sum debited from your debit/credit card for the goods. If you do not return the goods or do not pay the costs of delivery, we shall be entitled to deduct the direct costs of recovering the goods from the amount to be credited to you. 5. Delivery Where the goods are in stock on receipt of your order we will deliver within 28 days of your order. Otherwise, we will deliver the goods to you as soon as possible after we have received them and once we have accepted your order. Any dates quoted for delivery are estimated delivery times only. Delivery shall be made by recorded post. Delivery details cannot be changed after you have placed your order. You will become the owner of the goods on delivery (unless you cancel your order under Section 4) and once the goods have been delivered they shall be held at your risk. BFPO addresses are charged at the standard UK rates and are sent via the Forces Internal Mail service. Once the goods have been delivered to the BFPO, we cannot accept responsibility for the items and risk in the goods passes to you. We are unable to deliver to certain locations around the world. If your location is not listed on our website when you are entering a delivery or billing address then we will not be able to accept your order. We are not responsible for any direct or indirect or consequential loss caused by late delivery or failure to deliver, except where the same results from our negligence. 6. Notification of Changes We reserve the right to change, modify, remove or substitute without notice any information shown on the website. Prices and availability of goods are subject to change without prior notice. 7. Payment by Overseas Customers As we are a UK company, all charges shown on the website are in Pounds Sterling. If you are purchasing from overseas, paypal will covert the payment into your local currency. This website and our Terms and Conditions have been designed for use within the United Kingdom. Whilst we will consider requests for products and enquiries from outside the United Kingdom, we give no warranty, express or implied, that our website or the placing of any order through this website from outside the UK complies with any applicable non-UK laws or regulations. Accordingly, any products or promotions not permitted under your local law are not offered to you. 8. Import and Local Taxes You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from our site. The importation or exportation of certain of our goods to you may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import of the goods you purchase. 9. Refunds and Exchanges If goods have been despatched as ordered but are unwanted you can return them to us within the terms outlined in section 4 above. In these circumstances, we do not refund any delivery charges paid by you or the costs of return. If the goods have not been delivered to you within 14 days of our giving notice of despatch to you, you must notify us so that we can make good the non-delivery. We are not responsible for non-delivery unless notified. If the goods delivered to you are not the goods ordered or are damaged or defective, you must return the goods delivered to us (at our cost) within 14 days of receipt. We will either (at your option) replace any goods or refund you the price (including any delivery charge paid by you and any postage costs incurred by you in returning the goods). Please note that we regret that we cannot be held responsible for non-delivery of returned goods and we therefore we suggest you use a secure delivery method which requires a signature upon delivery. Cancellation by us We reserve the right to cancel the contract between us if: • we have insufficient stock to deliver the goods you have ordered; • we do not deliver to your area; or • one or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers. If we do cancel your contract we will notify you by e-mail and will credit to your account any sum debited from your credit card in respect of the relevant goods as soon as possible but in any event within 30 days of accepting your order. 11. Data Protection We will process any personal data provided to us under this contract in accordance with the Data Protection Act 1998. By providing us with your personal data you consent to the processing of the data for the purpose of fulfilling your order and any other purposes indicated by you on our Order Form. This may involve our disclosing your data to third parties. Paypal use encryption software in an attempt to keep your data secure. However, we cannot guarantee that any messages transmitted over the internet will not be corrupted or intercepted by a third party. We exclude liability for any loss or damage arising from disruption, loss of or corruption of any communications sent to or received by us electronically, except where caused by our own negligence. 12. Liability The limit of our liability to you is the exchange of the goods for products of equivalent value or the refund of the price as provided for in Section 9. We will not be responsible to you to any greater extent and we are not responsible for any indirect or consequential loss which you may incur arising out of our failure to comply with these terms and conditions. Nothing in these terms and conditions is intended to exclude or limit our liability to you for any death or personal injury resulting from our negligence or to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded. We shall have no liability to pay any money to you by way of compensation. 13. Events beyond our control We shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage to or defect in goods delivered caused by any event or circumstance beyond our reasonable control including, without limitation, theft or loss within the postal system after confirmation of despatch, strikes, lock-outs and other industrial disputes, breakdown of systems, flood, fire, explosion or accident. 14. Invalidity If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected. 15. Privacy Your personal data will not be used in conjunction with, or intentionally shared or given to any other company or organisation. 16. Third party rights A person who is not a party to this agreement has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement. 17. Entire agreement These terms and conditions, together with your Order Form, our current website prices, contact details and privacy policy, set out the whole of our agreement relating to the supply of the goods to you by us. Nothing said by any sales person on our behalf should be understood as a variation of these terms and conditions or as an authorised representation about the nature or quality of any goods offered for sale by us. Except for fraud or fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading. 18. Governing Law & Jurisdiction These Terms and conditions shall be governed and construed in accordance with the laws of England and Wales. Disputes arising here shall be exclusively subject to the jurisdiction of the courts of England and Wales. |
